Responding to Recent Communications Circulating About Fair Water Texas

Across the past several weeks, individuals in multiple Texas communities have forwarded messages they received from a man named Danny Flunker, who has been contacting homeowners, neighborhood groups, and intervenors involved in Public Utility Commission (PUC) dockets. His emails and posts contain a series of personal accusations about me and about Fair Water Texas.

Because these messages are being distributed statewide — often to people who have never met me and have no connection to the history he references — it is important to provide clear context and reaffirm what Fair Water Texas actually does.

What Fair Water Texas Is — and Is Not

Fair Water Texas exists for one purpose: to help ratepayers understand the PUC process, organize effectively, and ensure their voices are heard in proceedings that directly affect their water service and their bills.

Our work is transparent, public, and grounded in the belief that Texans deserve fair rates, reliable service, and a seat at the table when decisions are made about their water.

Why These Attacks Are Appearing Now

When communities begin organizing, utilities and their allies often become uncomfortable. Ratepayers who are informed, coordinated, and active in the PUC process are far harder to ignore.

In both the Aqua Texas and Texas Water Utilities cases — Docket 58124 and 58628, respectively — homeowners across the state are stepping forward in unprecedented numbers. That level of engagement is new, and it is powerful.

It is also, for some, inconvenient.

The messages circulating from Mr. Flunker are not coming from anyone involved in your case, your community, or your water system. They are not coming from Aqua Texas. They are not coming from the PUC. They are coming from a single individual who has been publicly attacking me for several years and is now attempting to insert himself into unrelated communities across Texas.

About the Claims Being Circulated

Mr. Flunker’s emails and posts repeat a set of allegations he has made for years, all tied to a long‑running dispute inside his own neighborhood’s water supply corporation. Those internal disputes — involving multiple boards, multiple factions, and multiple legal actions — have no connection to Aqua Texas or Texas Water Utilities, to your community, or to the work Fair Water Texas is doing today.

The PUC record speaks for itself. Anyone can review it. And unlike Mr. Flunker’s messages, the PUC record is not filtered through personal animosity or selective interpretation. Whereas Mr. Flunker prefers certain documents that were not validated by Judges, I would offer this singular document as to what Judges did say. Nonetheless, you can also review a sense of my advocacy for my neighborhood’s utility company at the PUC in the videos below.

What You Should Know Moving Forward

1. Fair Water Texas is not going anywhere. We will continue helping communities organize, file comments, understand filings, and participate meaningfully in the PUC process.

2. Our work is being offered to you without charge, but donations in consideration of the work peformed is appreciated.

3. You can always contact me directly. If you receive a message about me or about Fair Water Texas and want clarification, I will answer your questions openly and directly.

4. Your community’s situation is real and urgent. Aqua Texas and Texas Water Utilities have had numerous consumer issues to the fore. None of that changes because someone from outside your community sends an email disparaging this organization because he has personal issues with the founder, Joe Gimenez.

Fair Water Texas is focused on helping Texans navigate a complex regulatory system that affects their daily lives. Personal attacks — especially from individuals with no connection to your case — do not change the facts, the filings, or the stakes for your community.
