PUC Staff Appeal of Order No. 5 in Docket 58124
Staff recommends that fixing interim rates until a final rate determination is made by the Commission is supported by both statutory authority, the Commission' s rules, and Commission precedent. Furthermore, the implementation of initial rates will best serve the public interest, as Aqua will still earn its proposed rates from its second errata to the application, and both Aqua and ratepayers will be made whole if the rates finally approved by the Commission differ from the interim rates collected during the pendency of this proceeding. Therefore, Staff respectfully requests that the Commission reverse SOAH Order No. 5 and grant Staff' s motion for interim rates through a final order in this proceeding.
